The following is the content of a letter sent to the Regional Administrator at the USEPA, Region 2, Judith A. Enck. The letter was signed on April 4, 2013 by Joseph J. Martens, Commissioner.
The New York State Department of Environmental Conservation (DEC) is submitting a final state implementation plan (SIP) revision entitled "New York State Implementation Plan for the Infrastructure Assessment for Ozone under Sections 110(a)(1) and (2) of the Clean Air Act" for your approval. This SIP revision addresses each of the required elements of Clean Air Act (CAA) section 110(a)(2), and affirms that New York State's SIPs meet the requirements of CAA sections 110(a)(1) and (2), including the "good neighbor" transport provisions of section 110(a)(2)(D). It replaces the December 14, 2012 submittal.
The proposal underwent a public review process that included a Notice of Public Hearing that was published in the Environmental Notice Bulletin, Newsday, New York Post, Albany Times Union, Glens Falls Post Star, Syracuse Post-Standard, Rochester Democrat and Buffalo News on January 2, 2013. A legislative public hearing was held in Albany on February 5, 2013. DEC accepted written comments until the close of business on February 12, 2013. Three comments were received.
