The following is the content of a letter sent to the Regional Administrator at the USEPA, Region 2, Judith A. Enck. The letter was signed on October 3, 2013 by Joseph J. Martens, Commissioner.
Pursuant to §110(a)(1) and (2) of the Clean Air Act, States are required to address basic State Implementation Plan (SIP) requirements related to the attainment of new or revised National Ambient Air Quality Standards (NAAQSs), including emission inventories, monitoring and modeling to assure attainment, maintenance and enforcement of the standards. As such, we are pleased to provide you with the State Implementation Plan for the infrastructure assessment for sulfur dioxide under §110(a)(1) and (2) of the Clean Air Act, in response to the promulgation of the one-hour primary NAAQS for sulfur dioxide on June 2, 2010.
SIPs meeting the requirements of CAA §110(a)(1) and (2) must be submitted within three years after promulgation of a new or revised standard. §110(a)(1) contains the general requirements for submitting a SIP to address a new or revised primary NAAQS; §110(a)(2) contains the specific elements to be included in these plans.
In the absence of guidance that addresses the requirements of CAA §110(a)(1) and (2) requirements specifically for the SO2 one-hour primary NAAQS, EPA has advised states to use the October 14, 2011 CAA §110(a)(1) and (2) guidance that addresses the lead (Pb) NAAQS, where applicable. In that context, this submission addresses each of the required elements of CAA §110(a)(2), and affirms that New York's infrastructure assessment SIP for the SO2 one-hour primary NAAQS meets the requirements of CAA §110(a)(1) and (2).
