The following is the content of a letter sent to the Regional Administrator at the USEPA, Judith A. Enck. The letter was signed on August 30, 2010 by J. Jared Snyder, Assistant Commissioner, Office of Air Resources, Climate Change and Energy.
The New York State Department of Environmental Conservation (Department) is submitting to EPA a collection of single-source Reasonably Available Control Technology (RACT) determinations. These RACT determinations for emissions of nitrogen oxides (NOx) and volatile organic compounds (VOC) from 14 facilities within New York State require EPA approval as State Implementation Plan (SIP) revisions. These revisions will decrease ozone-forming emissions to aid in the goal of attaining the 8-hour ozone National Ambient Air Quality Standard (NAAQS) as expeditiously as practicable. This supplements a collection of 34 such revisions submitted to EPA in September, 2008.
The Department published a notice in the Environmental Notice Bulletin on July 7, 2010. It provided a 30-day period for comment, or for the request of a public hearing related to these revisions. During this time, the Department received no comments, nor did it receive any requests for a public hearing.
With this package you will find the following:
- A copy of the Public Notice published in the Environmental Notice Bulletin on July 7, 2010;
- A table of detailed information on the sources being included, with information on what constitutes RACT for each source;
- The lists of applicable NOx and VOC sources that were included with the September, 2006 RACT SIP, with updated status for each source;
- The RACT determination analysis and proof of Department approval for each facility.
