Notice of Test Plan Availability
The New York State Department of Environmental Conservation (DEC) has approved the RED Confirmatory Performance Test (CfPT) plan dated May 30, 2025 (revised June 25, 2025 and June 27, 2025). The performance test is designed to demonstrate compliance with the air emission standards required by the Maximum Achievable Control Technology (MACT) for the Hazardous Waste Combustors Rule promulgated by the United States Environmental Protection Agency (USEPA), specifically 40 CFR Part 63 Subpart EEE. The facility incinerates solid waste generated from the on-site wastewater treatment plant in accordance with a Title V Permit (DEC Permit #8-2699-00126/00001). The plan also includes information on a performance evaluation for the continuous monitoring systems (CMS) and for the continuous emissions monitoring systems (CEMS) to be performed as part of the test.
In accordance with 40 CFR Part 63.1207(e)(2), RED must issue a public notice announcing the approval of the test plan and the location where the test plan will be available for review. The public has 60 days to review.

Project Location/Description: RED operates a multiple hearth incinerator at the Eastman Business Park facility in Rochester New York. The hazardous waste (HW) incinerator is designed to treat solid waste generated from the on-site wastewater treatment plant. Solid waste feed to the unit consists of a combination of dewatered wastewater treatment sludge and dewatered wastewater grit. Dewatered sludge is the primary component. The incinerator is subject to the requirements of the hazardous waste combustor (HWC) maximum achievable control technology (MACT) rule, 40 CFR Part 63 Subpart EEE and is operated in accordance with the terms and conditions of the Title V Permit (DEC ID#8-2699-00126/00001).
Pursuant to the Maximum Achievable Control Technology (MACT) for Hazardous Waste Combustors Rule promulgated by the United States Environmental Protection Agency (EPA), RED is required to conduct a CfPT to demonstrate compliance with the air emission standards in the rule, specifically 40 CFR Part 63 Subpart EEE. RED has submitted a CfPT plan that includes tests for air emissions of dioxin/furans while incinerating solid waste generated from the on-site wastewater treatment plant. The plan includes a performance evaluation for the continuous monitoring systems (CMS) and for the Continuous Emissions Monitoring Systems (CEMS).
A copy of the plan is available for review at the DEC webpage and at the address provided below from July 16, 2025 –September 15, 2025 (or 60 days from the date of the newspaper notice, whichever is later). Interested persons may contact RED or DEC personnel with any questions or for additional information.
The DEC has determined the plan to be acceptable. This notice is pursuant to 40 CFR Part 63.1207(e)(2) which requires RED to publish this approval and make the plan available to the public for review.
