Organizational Report
Per 6 NYCRR 551.1, those involved in the following activities associated with regulated wells within the State must file an Organizational Report (PDF) (301 KB) with DEC:
- production;
- solution mining;
- underground gas or LPG storage;
- brine disposal;
- well drilling;
- well plugging;
- first transportation; or
- first purchase.
An authorized representative must sign the Organizational Report in the presence of a notary. The date of notarization must match the date of the authorized representative's signature. Other persons may be authorized to sign subsequent submittals to DEC if they are listed in Box 7 of the Organizational Report.
If any information on the current Organizational Report changes, an updated Organizational Report is required to be filed with DEC within 30 days of the change. Any corporation listed on the New York or American Stock Exchange must update its Organizational Report annually no later than March 31st.
Any person or other entity required to file an Organizational Report that ceases involvement in the above listed activities must notify DEC in writing within 30 days.
A completed and notarized Organizational Report should be mailed to the Division of Mineral Resources, NYS DEC, 625 Broadway, Albany, New York 12233-6500. Operators are required to mail the original Organizational Report to DEC; email and fax submittals are not acceptable.
