Collective Electronic Waste Acceptance Program Requirements

NYS Electronic Equipment Recycling and Reuse Act:

The New York State Electronic Equipment Recycling and Reuse Act (Act), which is based on the concept of product stewardship or extended producer responsibility, places responsibility for managing end-of-life covered electronic equipment (CEE) primarily on manufacturers, with oversight by the Department of Environmental Conservation (DEC).

The Act enables manufacturers of CEE to meet their collection requirements through individual or collective electronic waste acceptance programs. A collective is an organization that administers an electronic waste acceptance program on behalf of one or more manufacturers. Described in more detail below are the requirements for collectives acting on behalf of manufacturers.

For a full description of requirements that apply to collectives, please review the NYS Electronic Equipment Recycling and Reuse Act (Environmental Conservation Law, Article 27, Title 26) and the supporting Part 368-3 Regulations.

Summary of Collective Electronic Waste Acceptance Programs' Requirements:

1. Submit a one-time registration and registration fee. A collective must submit a one-time online certified registration to the Department via the E-waste Online Registration and Reporting System, and must submit a one-time registration fee of $10,000 to DEC. A registration must be updated within thirty days of any material change to the information previously provided.
2. Provide an electronic waste acceptance program. A collective electronic waste acceptance program must meet the same requirements as an individual manufacturer's electronic waste acceptance program.
3. Provide information to retailers. If written information regarding the collective electronic waste acceptance program is not included in its participating manufacturers' product manuals for CEE, then the collective must provide information on its program to retailers for distribution to consumers purchasing CEE of their participating manufacturers'.
4. Comply with disposal ban. A collective electronic waste acceptance program may not dispose of electronic waste at a solid waste management facility or hazardous waste management facility, or place electronic waste for collection which is intended for disposal at a solid waste management facility or hazardous waste management facility.
5. Submit an annual report. A collective must submit an online certified annual report to the Department via the E-waste Online Registration and Reporting System by March 1 annually for the previous year.
6. Maintain records. A collective must maintain records demonstrating compliance with the Act, and make them available for audit and inspection by the Department for a period of three years.
7. Request withdrawal, if applicable. A collective that intends to cease operating as a collective must request withdrawal of its registration and must:
   • notify the department of its request to withdraw, in writing on company letterhead, at least 90 days prior to ceasing operation as a collective and include the date the collective plans to cease operating its electronic waste acceptance program;
   • meet the annual reporting requirements of this section for the calendar year in which the collective's registration is withdrawn; and
   • notify participating manufacturers and program partners in writing at least 90 days prior to the date the collective will cease operation as a collective and provide a copy of such notification to the department.

Revocation of a Registration:

The department may revoke a collective's registration, pursuant to 6 NYCRR Section 621.13, if the collective fails to comply with any of the requirements of the Act or Regulations. A collective must still meet the annual reporting requirements of this section for the calendar year in which the collective's registration was revoked.
