Brownfield Cleanup Program - Work Plan and Report

Certain documents, including work plan and reports, are required to be submitted for DEC and NYSDOH review and approval. The DEC Project Manager assigned to your site will work with you to provide guidance on required document submittals and relevant deadlines.

Key deadlines:

  • A draft Work Plan must be submitted within 30 days of the effective date of the Brownfield Cleanup Agreement (BCA).
  • The Citizen Participation Plan must be submitted within 20 days after the effective date of the BCA
  • Work plans shall include schedules for future work

Documents that must be submitted under the BCP include, but may not be limited to, the following:

Remedial Investigation Work Plan (RIWP): The RIWP provides for the investigation of the nature and extent of contamination within the site boundaries. Participants must also investigate the extent of contamination emanating from the site. Volunteers shall perform a qualitative exposure assessment of contamination emanating from the site.

Interim Remedial Measures (IRM) Work Plan: an IRM may be proposed to mitigate environmental or human health exposures before the completion of the RI and remedy selection. For non-emergency IRMs, an IRM Work Plan should be submitted for approval. Consult with the DEC Project Manager before submitting an IRM Work Plan to determine if this is an appropriate course of action.

Remedial Investigation Report (RIR): The RIR must be submitted to document the results of the remedial investigation performed pursuant to DER-10. The RIR should make a recommendation as to whether any remediation is necessary.

Remedial Action Work Plan (RAWP), Remedial Work Plan (RWP) or Alternatives Analysis Report (AAR): The RAWP, RWP or AAR evaluate and recommend remedial actions and applicable technology to address site contamination. The terms RWP and RAWP are used interchangeably in DEC's Brownfield Cleanup Program.

Site Management Plan (SMP): Unless the site has achieved a Track 1 (link leaves DEC website) Unrestricted Use Cleanup, an SMP must be submitted in order to manage contamination remaining at the site, and any engineering controls installed as part of the remedy. The SMP is typically included as an appendix to the FER.

Final Engineering Report (FER): Following remediation, a FER must be submitted to document that the remediation was performed in accordance with the approved RAWP. The FER must be approved by DEC before a Certificate of Completion can be issued. Unless the site has achieved a Track 1 Unrestricted Use Cleanup, a Site Management Plan (SMP) must be included as an appendix to the FER.
