The RCRA Facility Investigation Report for Operable Unit #9 (Former Research and Development Property) (44 page PDF, 2.08 MB) was available for public review and comment. The comment period was from March 3, 2014 through April 2, 2014.
DEC and U.S. Environmental Protection Agency (EPA) (together referred to as the "Agencies"), is providing a summary of environmental information collected to date and contained in a document entitled RCRA Facility Investigation (RFI) Report Volume III - Former Research and Development Property (Operable Unit 9; Former R&D Property). The Former R&D Property is a 10.5 acre area located southwest of the FMC Facility in Middleport, New York, and comprises three parcels that are zoned for light industrial land uses. In 1985, FMC sold this property. Since 1986, it has been used for various commercial purposes. The RFI Report documents the results of environmental investigations (soil sampling and analysis) that have been conducted on this property since 1973. In addition to the RFI Report, the Niagara County Department of Economic Development retained a consultant to perform a Phase II Environmental Site Assessment (ESA) at the property. A Phase I ESA was performed in 2007. The Phase II ESA was conducted in order to identify the level of environmental contamination (if any), and to determine feasible redevelopment options and corresponding site remediation costs. While the RFI was solely for soils at the site, the Niagara County ESA sampled soils and groundwater. Additionally, a container and material inventory was conducted along with an asbestos and lead-based paint survey of onsite structures.

Written Comment Period Closed: The Agencies were accepting written comments from the public on the RCRA Facility Investigation (RFI) Report Volume III - Former Research and Development Property (OU-9). The Agencies were not involved with the planning, sampling and preparation of the Niagara County ESA.
The 30 day comment period was from March 3, 2014 through April 2, 2014.
