Status Of Local Solid Waste Management Plans (LSWMP)

As of June 2025, there are 42 local planning units (LPU) with approved plans, 23 are in the process of developing an approvable plan, and 4 have plans that are expired or have not yet submitted a LSWMP. DEC has categorized the status of the local solid waste management plans in six groups as follows:

• Approved LSWMP
• Approvable Letter Issued
• Draft LSWMP made available for public participation
• Comments Issued: Draft LSWMP has been submitted and commented on, however, the LPU has not yet submitted a response to these comments or an updated draft LSWMP.
• Draft LSWMP received: Draft LSWMP has been received and is under review, no comments have been provided yet.
• Expired LSWMP's: A new plan has not been submitted by the LPU, however, the LPU had an approved plan at some point.
• No LSWMP: The LPU has never had a LSWMP approved and has not yet submitted a draft to the department.

DEC encourages all planning units with expired or expiring LSWMPs to initiate efforts to develop successor plans and is working with planning units that are in various stages of development related to their solid waste management plans. Under these circumstances, DEC considers solid waste management facilities receiving waste from those planning units to be compliant with Part 360 regulations. In circumstances where this is not the case, DEC will make affirmative contact with the appropriate facilities.

There are 41 municipalities in the State that are not affiliated with a recognized planning unit.
