Forest product sales occur on State Forests, which were purchased for watershed protection, timber production, wildlife habitat, recreation and similar purposes. Maple tapping sales occur within limited areas selected by DEC foresters.
Pursuant to Section 9-0505 of the Environmental Conservation Law, DEC "may sell the trees, timber and other products" on State Forests, including but not limited to "the sap from maple trees." The areas available for tapping are marked by DEC foresters and sold to the highest responsible bidder through a public, competitive bidding process.
Sale contracts include provisions allowing maple syrup producers to access state lands and establish systems necessary to collect sap, usually over multiple seasons. Contracts require producers to minimize impacts on recreational use and abide by best management practices (BMPs) to protect environmental resources. These BMPs include restrictions to avoid wet soil conditions and equipment restrictions to protect sensitive areas, among others.
