- Project Description:
The NYSDEC proposes annual maintenance of Bellinger Brook, part of the 1964 Herkimer Flood Control Project, between the culvert under NYS Route 5 and the pedestrian bridge located 1,000-feet upstream at the Herkimer High School in the Village of Herkimer, Herkimer County. Sediment will be removed in the dry with excavation performed no deeper than six (6) inches above the water line. Removal of sediment will restore the capacity of Bellinger Brook back to the 1964 as-built state. All excavated material will be disposed of outside of the mapped flood zone and further than 100-feet from any wetland.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

- State Historic Preservation Act (SHPA) Determination:
- The proposed activity is not subject to review in accordance with SHPA. The application type is exempt and/or the project involves the continuation of an existing operational activity.

- This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
- DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)
