Project Description:
The Town of Sandy Creek proposes to install a new water main extension along North Rainbow Shores Road, South Sandy Pond Inlet Road, and West Shore Drive. The current application revises a previous proposal submitted to DEC in 2021 for a new water main in many portions of the same location, which DEC denied on February 8, 2022. In the revised application, the new water main will dead end at the northern end of North Rainbow Shores Road and the southern end of South Sandy Pond Inlet Road. The water main will be an extension of the Richland-Sandy Creek Joint Water Project that was recently constructed. The proposed extension is approximately 4,250 linear feet, with approximately 3,550 linear feet located within a Coastal Erosion Hazard Area regulated under 6 NYCRR Part 505. The application includes a request for a variance from the restriction at 6 NYCRR Part 505 (d) (5): “All development is prohibited primary dunes unless specifically allowed by this subdivision.” The water main is proposed to be directionally drilled under the South Sandy Pond Channel and trenched within the road limits of West Shore Drive, South Sandy Pond Inlet Road, and North Rainbow Shores Road. Based on the application material reviewed, DEC has tentatively determined to deny the application. DEC will review and consider all public comments before making a final determination.

State Environmental Quality Review (SEQR) Determination:
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency: Sandy Creek Town Board
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
DEC Commissioner Policy 29, Environmental Justice and Permitting (CP-29)
It has been determined that the proposed action is not subject to CP-29.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than May 9, 2024.
