Notice of Proposed Rule Making - Amendments to 6 NYCRR Parts 701, 703, 864, 890, 891, 920, and 935 - Saline Water Quality Standards & Reclassification Rule 1;
Notice is hereby given that the New York State Department of Environmental Conservation (NYS DEC) has filed a Notice of Proposed Rule Making with the New York State Department of State to amend 6 NYCRR Parts 701, 703, 864, 890, 891, 920, and 935, titled “Saline Water Quality Standards & Reclassification Rule 1.” The proposed regulatory updates modify how the wet weather (WW) limited use designation can be applied, amend water quality standards (WQS) to protect off-season secondary contact recreation best uses in saline waters, and amend classifications of 30 formerly Class I or SD waterbody segments to Class SB, SB(WW), or SC. The SB(WW) reclassifications are applicable to two segments of the Harlem River and are supported by a Use Attainability Analysis (UAA).
Public Hearing Time and Location
Two public comment hearings for the proposed rule will be held on June 16, 2025 (virtual) and June 18, 2025 (in-person).

Public Comment on the Proposed Rule Making
The public comment period commences on April 16, 2025. Written statements must be submitted to the NYS DEC by 11:59 p.m. on June 26, 2025.
Environmental and Regulatory Impact Review
NYS DEC determined that the proposed rule making will not have a significant adverse environmental impact. NYS DEC prepared a Regulatory Impact Statement, a Regulatory Flexibility Analysis for small businesses and local governments, a Rural Area Flexibility Analysis and a Job Impact Statement, in accordance with the State Administrative Procedure Act.
