The Department prepared a draft permit and made a determination, subject to public comment or other information to issue a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) permit NY0002763, pursuant to 6 NYCRR 621.13 and 6 NYCRR 750-1.18, as well as the Environmental Benefit Permit Strategy pursuant to ECL 17-0817(4), 6 NYCRR 750-1.16(f), and 6 NYCRR 750-1.19 The permit is for an industrial facility that processes dairy food products subject to federal effluent limitation guidelines (ELGs). The facility discharges treated process wastewater, cooling water, and artesian well water through Outfall 001 and stormwater through Outfall 002. Treatment for process wastewater occurs via lagoon treatment system. A full technical review of the permit identified changes that are necessary to improve the water quality in Deer River. Notable changes include: addition of Outfall 01A for application of technology-based limits prior to the admixture of cooling water and artesian well overflow including updated effluent limitation guideline (ELG) limits for BOD5 and TSS to reflect production at the facility and addition of a technology-based limit for Total Phosphorous, reduction of the ammonia limit at Outfall 001, addition of dissolved oxygen, total nitrogen, nitrate, nitrite, total kjeldahl nitrogen, and total dissolved solids monitoring at Outfall 001, addition of quarterly WET testing on a 5-year schedule, addition of monitoring to Outfall 002 after a qualifying storm event, and addition of special conditions for the annual reporting of production and lagoon maintenance. The draft permit files are contained within regional folders and named by the SPDES number contained in this notice. Requests for a public comment hearing or adjudicatory proceeding must be sent in writing to the DEC contact person below by the comment deadline. The Department assesses such requests pursuant to 6 NYCRR Section 621.8. Refer to this application by the application number listed above and SPDES Number NY0002763.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

It has been determined that the proposed action is not subject to CP-29.
