Notice of Adopted Rulemaking - 6 NYCRR Part 375, Environmental Remediation Programs
Notice is hereby given that the New York State Department of Environmental Conservation (DEC) has adopted revised 6 NYCRR Part 375, Environmental Remediation Programs. The revisions are effective on December 31, 2025, the date that the Adoption Notice is published in the State Register.
The amended rulemaking was noticed in the July 2, 2025, issue of the State Register. This rulemaking amends 6 NYCRR Part 375, Environmental Remediation Programs, to conform with both the 2015 and 2022 Amendments with respect to the Brownfield Cleanup Program (BCP) at ECL Article 27, Title 14; addresses and enhances requirements pertaining to the Inactive Hazardous Waste Disposal Site Remedial Program (State Superfund Program, SSF) at ECL Article 27, Title 13 and the Environmental Restoration Program (ERP) at ECL Article 56, Title 5; and updates the soil cleanup objectives (SCOs) based on review and comments received by DEC staff and the New York State Department of Health. The rulemaking incorporates needed changes, clarifications, and modifications to the regulations based on the experience developed during the first decade of implementing the BCP.
