Notice of Test Plan Availability
DEC has approved the Durez Confirmatory Performance Test (CfPT) plan submitted February 18, 2022. The performance test is designed to demonstrate compliance with the dioxin/furan emission standard required by the maximum achievable control technology (MACT) for the Hazardous Waste Combustors Rule promulgated by the United States Environmental Protection Agency (USEPA), specifically 40 CFR Part 63 Subpart EEE. The facility incinerates both on-site and off-site liquid hazardous wastes in accordance with a Title V Permit (DEC Permit # 9-2911-00111/00105). The plan also includes information on a performance evaluation (PE) for the continuous monitoring systems (CMS) and a relative accuracy test audit (RATA) for the continuous emissions monitoring systems (CEMS) to be performed as part of the test.
In accordance with 40 CFR Part 63.1207(e)(2), Durez must issue a public notice announcing the approval of the CfPT plan and the location where the CfPT plan will be available for review. The public has 60 days to comment, ending June 7, 2022. The approved plan, including a tentative schedule (PDF), is available for review at the DEC offices in Albany and Buffalo as well as the Earl Brydges Public Library, 1425 Main Street, Niagara Falls.

Project Location/Description: Durez Corporation operates an incinerator on-site that incinerates liquid hazardous waste generated from phenolic resin manufacturing operations at the facility. Durez also incinerates similar liquid wastes received from Durez Canada Company LTD located at 100 Dunlop Street, Fort Erie, Ontario, Canada. The incinerator is subject to the requirements of the hazardous waste combustor (HWC) maximum achievable control technology (MACT) rule, 40 CFR Part 63 Subpart EEE and is operated in accordance with the terms and conditions of the Title V Permit (DEC Permit # 9-2911-00111/00105).
The HWC MACT Rule requires a CfPT, including a continuous monitoring system performance evaluation (PE) to be completed (two and a half years after the successful completion of a full Comprehensive Performance Test) to demonstrate continued compliance with the dioxin/furan emission standard. The test plan has been submitted to the DEC for review and approval. A copy of the plan is available for review at the DEC webpage and at the address provided below from April 6, 2022 through June 7, 2022.
