On August 4, 2020, the New York State Department of Environmental Conservation (NYSDEC) filed a Notice of Proposed Rule Making with the New York Department of State to repeal 485.1 of Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (6 NYCRR). The proposed consensus rule making removes inaccurate and redundant information in regulation to eliminate confusion for the regulated community. This proposed rule making only removes the SPDES program fees from the regulations, the fees are still required pursuant to the ECL.
The Notice of Proposed Rule Making is published in issue 33 of the State Register, dated August 19, 2020. The public comment period closed on October 19, 2020. No comments to the consensus rule making were received.
