Adopted Amendments To 6 NYCRR Parts 700, 703, And 890, BEACH Act Standards And Reclassification Rule
Adopted June 4, 2019, effective November 1, 2019, the New York State Department of Environmental Conservation (NYS DEC) adopted amendments to Parts 700, 703 and 890 of Title 6 of the Official Compilation of Codes, Rules, and Regulations of the State of New York (6 NYCRR). These amendments establish new water quality standards for all coastal recreation waters to meet the requirements of the federal Beaches Environmental Assessment and Coastal Health (BEACH) Act of 2000 (P.L. 106-284). The amendments also reclassify certain Class I waters consisting of Upper New York Bay and a portion of Lower New York Bay to add the best usage of primary contact recreation to these waters.
This rulemaking was originally proposed on March 21, 2018. The public comment period was open from March 21, 2018 through June 12, 2018. Public Hearings were held on June 5, 2018 in Avon, NY and on June 7, 2018 in Long Island City, NY. In response to public comment, NYS DEC issued revisions to the proposed rule on February 27, 2019. The public comment period for the revised rule was open from February 27, 2019 through April 15, 2019.
