Under Sections 33-0301 and -0303 of the Environmental Conservation Law (ECL), DEC has jurisdiction in all matters pertaining to the distribution, sale, use and transportation of pesticides. DEC also regulates the registration, commercial use, purchase and custom application of pesticides.
Pesticides, when properly used for the control of insects, fungi, weeds, and nematodes, and as defoliants, desiccants, and plant regulators and for related purposes, are valuable, important and necessary to the welfare, health and economic well-being of the people of New York. However, such materials, if improperly used, may injure health, property and wildlife.
For compliance and enforcement purposes, DEC promulgates regulations pursuant to State laws and issues policies as part of compliance assistance.
