How To Comment on Fish and Wildlife Proposed Regulations
The public is encouraged to comment on any proposed rules. Comments must be made in writing and must be submitted according to the instructions provided for each proposal. Address your comments to the agency representative whose name and address appears below the link to the express terms. No special form is required: a handwritten letter or e-mail is acceptable. For e-mail submissions, to ensure that the Department receives and can properly review your comment(s), you must leave the subject line as it appears on the e-mail address link. Due to the high volume of comments received, the Department will be unable to reply to individual submissions. However, all comments will be incorporated into an Assessment of Public Comment and published in the NYS Register with the Notice of Adoption.
To be considered, comments must reach us before the proposed rule is adopted. The law provides for a minimum 60-day public comment period after publication in the NYS Register of every Notice of Proposed Rule Making; and a 45-day public comment period for every Notice of Revised Rule Making. If a public hearing is required by statute, public comments are accepted for at least five days after the last such hearing. The last date on which the Department will accept public comment is shown in red text below the link to the express terms.
When a time frame calculation ends on a Saturday or Sunday, public comment will be accepted through the following Monday. When a time frame calculation ends on a holiday, public comment will be accepted through the following workday. The Department cannot take action to adopt a rule until the day after public comments are due.
Also, in addition to sending comments or recommendations to the Department, please do not hesitate to transmit your views to the Administrative Regulations Review Commission (ARRC). ARRC is charged with the task of reviewing newly proposed regulations to examine the issues of compliance with legislative intent, impact on the economy, and impact on affected parties.
