Notice of Adopted Rulemaking
The Department repealed and adopted a new 6 NYCRR Part 624, Permit Hearing Procedures to clarify the permit hearing process for administrative permit proceedings, enhance administrative efficiency, incorporate administrative precedent, and ensure consistency in permit proceedings.
In addition, the Department adopted amendments to Part 621, Uniform Procedures and Part 622, Uniform Enforcement Hearing Procedures, to provide consistency between the Parts and adopted amendments to Subpart 750-1, Obtaining A SPDES Permit and POSS Registration to provide procedural requirements for SPDES permits when a hearing is requested pursuant to sections 621.10, 621.11 or 621.13 and subdivision 624.2(a).
The Department filed a Notice of Adoption with the Secretary of State that was published in the State Register on August 21, 2024. The regulations are effective on August 21, 2024 and are available below.

The Department repealed 6 NYCRR Part 622, Uniform Enforcement Hearing Procedures and adopted a new 6 NYCRR Part 622, Uniform Enforcement Hearing Procedures to clarify the hearing process for administrative enforcement proceedings, enhance administrative efficiency, and ensure consistency in enforcement proceedings.
In addition, the Department adopted amendments to the definition sections of 6 NYCRR Part 620, Procedures for Issuance of Summary Abatement Orders, and Part 624, Permit Hearing Procedures, to make the definitions of terms shared by Parts 620, 622 and 624 consistent. The Department also adopted amendments to 6 NYCRR 621.10(a), 621.11(g) and 621.13(d) to require that a copy of a written request for a hearing made pursuant to those subdivisions be provided to the Chief Administrative Law Judge.
