Shellfish Shipper Permit (Class A)
Allows permit holder and employees of the permit holder to reship, pack, or repack shellstock which have been purchased from holders of valid shellfish shipper permits or shellfish digger permits in interstate commerce.
With This Permit You May Not
- Ship shellfish out of state unless the permit contains a condition authorizing such shipment.
- Purchase or receive shellstock from the holder of a digger's permit unless you possess a place of business in Nassau or Suffolk County and such permit contains a condition authorizing them to do so.
Fee: $300
Age Requirement: Applicants must be 18 years or older.
Permit Duration: Permit expires December 31 each year.

Step 1
- Contact DEC Shellfish Inspection Unit by email or call 631-444-0494 to request a permit application.
Step 2
- Submit an acceptable Shellfish HACCP Plan specific to your shellfish operation,
- Submit a shellfish dealer tag that includes all of the required information,
- Submit a shellfish shipping invoice that includes all of the required information,
- Complete the Good Manufacturing Practices (GMP) training provided by DEC,
- Have a facility that meets all of the requirements outlined in 6 NYCRR Part 42 Sanitary Control Over Shellfish.
Reporting Requirement
Permit holders that have authorization to buy from harvesters must submit a completed New York State Shellfish Landings Report Form (PDF) to DEC monthly, including for months in which no activities occurred. For months in which activities did occur, the permit holder shall report all wild harvested shellfish received from the holder of a digger's permit (the original harvester). Shellfish Processor Permit (Class B)
Allows permit holder and employees of the permit holder to reship, pack, or repack and process shellfish which have been purchased from holders of valid shellfish shipper permits or shellfish digger permits in interstate or intrastate commerce.
With This Permit You May Not
- Ship shellfish out of state unless the permit contains a condition authorizing such shipment.
- Purchase or receive shellstock from the holder of a digger's permit unless you possess a place of business in Nassau or Suffolk County and such permit contains a condition authorizing them to do so.
Fee: $600
Age Requirement: Applicants must be 18 years or older.
Permit Duration: Permit expires December 31 each year.

Shellfish Re-shipper Permit (Class C)
Allows permit holder and employees of the permit holder to reship shellfish which have been shipped by the holders of valid shipper permits in intrastate commerce.
With This Permit You May Not
- Ship shellfish out of state unless the permit contains a condition authorizing such shipment.
- Have your own shellfish dealer tags, you must distribute the shellfish exactly the way it is received (thus reshipper).
Fee: $200
Age Requirement: Applicants must be 18 years or older.
Permit Duration: Permit expires December 31 each year.

Shellfish Digger/Shipper Permit (Class D)
Allows permit holder to ship shellstock which the permit holder has legally harvested from the shellfish lands of the state.
With This Permit You May Not
- Ship shellfish out of state unless the permit contains a condition authorizing such shipment.
Fee: $75
Age Requirement: Applicants must be 18 years or older.
Permit Duration: Permit expires December 31 each year.
Application Requirements
Step 1
- Obtain a New York State Shellfish Digger Permit.
- Your shellfish dealer permit number will be the same as your digger permit number; however it will begin with NY, then your digger permit number, and end with SS which follows your digger permit number.
- Contact DEC Shellfish Inspection Unit by email or call 631-444-0494 to request a Class D permit application.
Step 2
- Submit an acceptable Shellfish HACCP Plan specific to your shellfish operation,
- Submit a shellfish shipping invoice that includes all of the required information,
- Submit a shellfish dealer tag that includes all of the required information,
- Complete the Good Manufacturing Practices (GMP) training provided by DEC,
- Have a facility that meets all of the requirements outlined in 6 NYCRR Part 42 Sanitary Control Over Shellfish.
Reporting Requirement
All permit holders must submit a completed New York State Shellfish Landings Report Form (PDF) to DEC monthly including for months in which no activities occurred. For months in which activities did occur, the permit holder shall report the direct sale of any shellfish to any person or business that does not possess a valid Class A or B permit such as restaurants, markets, bait dealers, direct consumers, etc. Review Shellfish Shipper Reporting Instructions (PDF) for complete details.

Bay Scallop Shucker/Packer Permit (Class E)
Allows permit holder (also including immediate family members and no more than two employees) to shuck and pack bay scallops received from the holder of a shellfish digger permit and to ship the shucked bay scallops in intrastate commerce.
With This Permit You May Not
- Purchase or receive shellstock from the holder of a digger's permit unless you possess a place of business in Nassau or Suffolk County and such permit contains a condition authorizing them to do so.
Fee: $50
Age Requirement: Applicants must be 18 years or older.
Permit Duration: Permit expires December 31 each year.

Certified Shellfish Shippers Dashboard
Use DEC's NYS Certified Shellfish Shippers Dashboard tool to check the shellfish permit certification status of suppliers and permitted operation authorizations such as receiving from diggers, interstate shipping, and aquaculture. This is a complete list of interstate & intrastate shellfish shippers that are certified by the NYSDEC shellfish inspection program. The users can filter the result by using different categories in the left side panel:
- Permit Type: SS (Shellfish Shipper), RS (Reshipper), SP (Shucker Packer)
- Permit Class: A (Shipper), B (Processor), C (Reshipper), D (D-Shipper) & E (Scallop Shop)

Additional Requirements for All Permits
- All shellfish must be obtained from an approved source. Use DEC's NYS Certified Shellfish Shippers Dashboard tool to check the shellfish permit certification status of potential/existing suppliers and permitted operation authorizations such as receiving from diggers, interstate shipping, and aquaculture.
- Water used from non-public water systems or private wells must be tested prior to use, after it has been repaired, and at least twice a year by an approved laboratory.
Renewing
A renewal form will be sent by mail prior to the permit expiration date. If a license renewal form is not received at least 2 weeks prior to the expiration date, please contact us by email or call the Marine Permit Office at 631-444-0470.
